Allegations of professional misconduct:
Ms Carrie Butterworth, while an Affiliate member of CILEx:
- Failed to maintain high standards of professional and personal conduct and justify public trust in herself, her profession and the provision of legal services by engaging in conduct that could undermine or affect adversely the confidence and trust placed in her and her profession by the public and others, contrary to Principle 2, outcome 2.2 of the CILEx Code of Conduct 2015;and
- Failed to act with integrity, contrary to Principle 3 of the CILEx Code of Conduct 2015 in that on or around 2 January 2018, she failed to seek clarification of a request from a member of the public for his phone call to be off the record at the earliest opportunity, which resulted him being misled into believing that his conversation would not be recorded and/or would be privileged from disclosure in legal proceedings to his detriment.
Ms Butterworth admitted both allegations of professional misconduct and agreed with CILEx Regulation to accept a sanction under a Determination by Consent Order.
Ms Butterworth accepted a warning and reprimand in respect of her conduct.
