Charges
The charge brought against TI was that he engaged in conduct unbefitting to a CILEx member or likely to bring disrepute upon CILEx or its members, contrary to Principle 4 of the IPS Code of Conduct for CILEx members.
The particulars to this were that:
(i) Between 28 February 2012 and 4 October 2012 TI, at all material times an Affiliate Member of CILEx, failed to respond to the enquiries of IPS and thereby failed to co-operate with IPS.
(ii) Between 4 October 2012 and 29 November 2012 TI failed to respond to a request of the Professional Conduct Panel to appear before it and thereby failed to comply with Rule 29(1) of the IPS Investigation, Disciplinary and Appeals Rules.
Outcome
The Tribunal found the charge proved in both particulars.
Sanction – Indefinite exclusion
The Tribunal ordered that TI be excluded from membership for an indefinite period. In making its determination the Tribunal made the following recommendations:
(i) In considering any application for reinstatement, CILEx shall require TI pay any outstanding subscription fees;
(ii) As part of any application for reinstatement TI must tender a satisfactory written explanation as to why he failed to engage with his regulator on this matter.
