Details of conduct / charges
The Disciplinary Tribunal (DT) found the following five charges of professional misconduct against Ayse Johnson proven on the balance of probabilities.
1. Ayse Johnson failed to maintain high standards of professional and personal conduct and justify public trust in her, her profession and the provision of legal services:
Contrary to Principle 2, Outcome 2.2 of the CILEx Code of Conduct 2019
2. Ayse Johnson failed to behave with honesty and integrity:
Contrary to: Principle 3, Outcomes 3.1, 3.2 and 3.5 of the CILEx Code of Conduct 2019
In that on or around 22 March 2022 Ayse Johnson misled or intended to mislead the Law Society by falsely representing on the Conveyancing Quality Scheme application that she was a Fellow of CILEX and a CILEx Conveyancing Practitioner when she knew this was not true.
3. Ayse Johnson failed to maintain high standards of professional and personal conduct and justify public trust in her, her profession and the provision of legal services:
Contrary to: Principle 2, Outcome 2.2 of the CILEx Code of Conduct 2019
4. Ayse Johnson failed to behave with honesty and integrity:
Contrary to: Principle 3, Outcomes 3.1, 3.2 and 3.5 of the CILEx Code of Conduct 2019
In that on or before November 2022 Ayse Johnson falsely represented her CILEX Membership status and professional experience to clients, solicitors and others and misled them or attempted to mislead them in to believing she was a Fellow of CILEX.
5. Ayse Johnson failed to comply with her legal and regulatory obligations and deal with regulators and ombudsmen openly, promptly and co-operatively:
Contrary to: Principle 4, Outcomes 4.1 and 4.2 of the CILEx Code of Conduct 2019
In that between December 2021 and October 2024, Ayse Johnson deliberately failed to declare to CILEx Regulation that she had been the subject of an investigation and subsequent charges for a public order offence when she knew or ought to have known that this would affect her CILEx Membership.
Outcome
The Disciplinary Tribunal found the above five charges proven on the balance of probabilities.
Sanction – indefinite exclusion
In accordance with Rule 30(5)(iv) of the CILEx Regulation Enforcement Rules, the Tribunal ordered that Ms Johnson be excluded from CILEX membership for an indefinite period.
