Charges
The charges against Mr. Charles Williams were:
Charge 1
Contrary Principles 1 and 2 of the Code of Conduct 2010 for CILEx members failed to:
(a) uphold the rule of law and the impartial administration of justice; and/or
(b) maintain high standards of professional and personal conduct
The particulars were that Charles Williams, on 21 May 2014, an Affiliate Member of CILEx, was tried and convicted in the Crown Court at Nottingham of Sexual Assault by penetration contrary to Section 2 of the Sexual Offences Act 2003. He was sentenced, on 12 June 2014, to 18 months imprisonment
Charge 2
Contrary to Principle 4 of the Code of Conduct 2010 for CILEx members, Principle 4 of the Code of Conduct 2015 for CILEx members and Rules 11 and 12 of the CILEx Investigation, Disciplinary and Appeals Rules 2015 failed to:
(a) comply with the CILEX and CILEx Regulation rules and bye-laws and/or comply with his legal and regulatory obligations and deal with regulators and ombudsmen openly, promptly and co-operatively, and/or declare prior conduct in a timely manner.
The particulars were that Charles Williams failed to declare Prior Conduct to CILEx or CILEx Regulation for the year 2015 at the earliest opportunity, or at all, knowing that he had been convicted of a criminal offence.
Outcome
Both charges were found proven.
Sanction – Indefinite exclusion
The Disciplinary Tribunal ordered that Mr. Williams be excluded from membership of CILEx indefinitely. The Tribunal ordered costs to be paid by Mr. Williams.
