A number of CILEx members have contacted CRL following the publication of the High Court ruling earlier this month. The ruling has made clear that Chartered Legal Executives wishing to conduct litigation must hold the appropriate litigation practice rights. This is consistent with CRL’s longstanding stance.

 

In light of the ruling, CRL are:

 

  • Readying guidance for Chartered Legal Executives on the conduct of litigation and supervision. This guidance will detail statutory restrictions on conducting litigation and assisting in the conduct of litigation.
  • Soon to submit an application to the LSB to enable Chartered Legal Executives to apply for standalone litigation rights. This will open up opportunities for CILEx members to be authorised to conduct litigation without the need to obtain advocacy practice rights.
