Details of conduct / charges

In accordance with Rule 18 of the CILEx Regulation Enforcement Rules (ER), MARILYN NEPTUNE, a Fellow of CILEx, admitted to the following allegations of professional misconduct against her:

i. Failing to maintain high standards of professional and personal conduct and justify public trust in you, your profession and the provision of legal services.
Contrary to Principle 2, Outcome 2.2 of the CILEx Code of Conduct 2019

ii. Failing to behave with honesty and integrity.
Contrary to Principle 3, outcomes 3.1 and 3.2 of the CILEx Code of Conduct 2019

In that on 4 July 2023, in an email, as part of a conveyancing transaction, Miss Neptune mislead the Nationwide Building Society into believing that she had met the requirements of the UK Lenders Handbook in relation to the maintenance arrangement of an unadopted road, when she knew or ought to have known that this was not true. As a consequence of Miss Neptune’s conduct, she was subject to a disciplinary hearing with her employer, who made a finding of dishonesty and serious neglect of her duties and dismissed her for gross misconduct.

Outcome – DBC

CILEx Regulation accepted the admission and agreed a Determination by Consent with Marilyn Neptune with the following sanction(s).

Sanction – Exclusion

Marilyn Neptune was excluded from CILEx membership for an indefinite period.
