Julie Goodman, whilst a Fellow of CILEX, admitted the following two allegations of professional misconduct:
Allegation 1
Contrary to Principle 3, Outcomes 3.1 and 3.2 of the CILEx Code of Conduct
and Principle 2, Outcome 2.2 of the CILEx Code of Conduct, Julie Goodman failed to behave with honesty and integrity, and failed to maintain high standards of professional and personal conduct and justify public trust in her, her profession and the provision of legal services, in that in November 2019, whilst employed as a Legal Executive Property Manager at a firm regulated by the SRA (the Firm), she signed a transfer document purporting to have witnessed her clients’ signatures when she had not, and allowed the Firm to submit the transfer document to the Land Registry, when she knew it had not been witnessed properly, in consequence of which, the Solicitors Regulation Authority on 2 February 2021 made her the subject of a control order under section 43 of the Solicitors Act 1974.
Allegation 2
Contrary to Principle 4, Outcome 4.1 of the CILEx Code of Conduct, Julie Goodman failed to comply with her legal and regulatory obligations and deal with her regulator openly, promptly and co-operatively, in that she failed to notify CILEx Regulation in writing at the earliest opportunity of the investigation into her fitness to practise by another regulator, namely the Solicitors Regulation Authority, in breach of Rules 11(1)(g) and 12(2) of the CILEx Regulation Enforcement Rules.
Outcome – Determination by Consent
Julie Goodman admitted all allegations and, in accordance with Rule 18(1) of the Enforcement Rules (ER), agreed to determine the allegations by consent and agreed a sanction that would be available to the Professional Conduct Panel or Disciplinary Tribunal.
Sanction – Exclusion – fixed period
The sanction was approved by the Professional Conduct Panel in accordance with Rule 18(3) ER Julie Goodman was excluded from CILEx membership for 3 years.
There is a right of appeal against this decision if received within 42 days of the decision date.
