Charges

Ms Fletcher admitted the following allegations of professional misconduct:-

Allegations

I.  Contrary to Principle 2, Outcome 2.2 of the CILEx Code of Conduct

failed to maintain high standards of professional and personal conduct and justify public trust in her, her profession, and the provision of legal services by engaging in conduct which could undermine or affect adversely the confidence and trust placed in her and her profession by her client, employer, professional colleagues, the public and others.

II.  Contrary to Principle 3, Outcome 3.1 and 3.2 of the CILEx Code of Conduct

failed to behave with honesty and integrity

in that Ms Fletcher

a)  fabricated letters of administration in relation to a probate estate which were purportedly dated 14 September 2020.

b)  misled clients on 25 September 2020, 16 October 2020 and 27 October 2020 in relation to whether letters of administration had been granted.

c)  fabricated the registration of an enduring power of attorney and misled her client in relation to the status of the same.

Outcome

Ms Fletcher admitted the allegations and, in accordance with Rule 18(1) CILEx Regulation Enforcement Rules, agreed to determine the allegation by consent and the imposition of exclusion from CILEX for a period of 36 months

Sanction – Exclusion

Ms Fletcher was excluded from CILEx membership for 36 months.
